Town Board Public Hearing- Sewer Effluent System Minutes – 04/20/2022-

CALL TO ORDER:
The meeting was called to order at 6:15 pm by Supervisor Entwistle

LEGAL NOTICE:
Supervisor Entwistle read the legal notice aloud.

PUBLIC COMMENTS:

  • Supervisor Entwistle started the meeting off by stating NYS set a directive that all NYS towns with sewer districts have this upgrade by 2024. Two years ago, the town received $20,000 to pay for almost all of the engineering report. The town also received a grant for 1.3 million dollars. The Sewer District is responsible for $375,000 if no loan is received. The town has applied for another grant to offset that cost but was denied. There is an opportunity for another grant, and the town will apply again. There are 80 units on the sewer district, so it would be an approximate $146/year assessed to each unit. It will be approximately $12-$16 more dollars a month per unit with a 30-year loan that only those on the sewer district will be responsible for.
  • Someone in the gallery asked when the original sewer loan from 1997 expires and it was answered 2032.
  • It was asked if the town is able to use money from the American Rescue Act for this project. Supervisor Entwistle stated the American Rescue Act money belongs to all taxpayers. Sewer and water revenue needs to stay with the sewer and water district.
  • It was asked who was writing the grants and it was answered, Jennifer Piper, from J. Piper Consulting; an independent woman owned business.
  • Construction will begin in 2023. Supervisor Entwistle thinks once the project is complete, the bills will be increased. He has reached out to Senator Griffo and Congresswoman Tenney’s offices to see what else could be done and is waiting on a response.

NOCCOG:
Lisa, from NOCCOG went over the monthly announcements. She stated the Local Government Conference had a good turnout.

OLD BUSINESS BOARD

  • Master Plan Committee: Supervisor Entwistle, Dave Ultsch, Bob Whitehead and Steven Addison are on the committee. There is another individual that may be joining. The Committee will meet once a month for no more than 90 minutes. Supervisor Entwistle has a Master Plan from another municipality that is very easy to read. The Committee will use this as a tool. Supervisor Entwistle has reached out to a local Municipal Planner for advice. She would know what types of questions to ask for the mailers that will be mailed to taxpayers. The town received a grant for $30,000 and the Committee will stay within that amount to cover data analysis, in-house staff, and mailings. The committee is all volunteer.
  • Website Design: Tracy Terry, the Town Clerk has been maintaining the town website since January. The new website should be running by the May meeting.
  • Quarry Update: The DOT will not move forward with signing off because of the driveway. Large trucks are unable to make a right-hand turn. This is on hold until the May Planning Board meeting.
  • Allison Variance: Supervisor Entwistle read aloud the five factors considered for a variance.

Mr. Bagley, from the gallery stated the Site Review Law is to protect future owners and he wouldn’t have purchased the lot if he knew the Board would violate their own Site Plan Law. Supervisor Entwistle stated he and the town’s Attorney reviewed the letter from Mr. Bagley’s Attorney. Discussion took place.
A motion was made by Councilwoman Verschneider and seconded by Councilwoman Abrial to approve the Allison variance.

  • Camp Nazareth: Registration will open Wednesday, April 27, 2022. Camp Nazareth has raised their rates to $425 per week and they charge the town $300 a week. First time campers will be free and campers that have gone before will be $50. Priority will be given to children who live in Forestport and then it will be open to grandchildren of taxpayers.
  • EZ-Pass: The Town Clerk has EZ-Pass on the Go available in her office for $25.00. There is a website for you to go on and register once purchased.

NEW BUSINESS BOARD:

  • Alder Creek Solar update: Supervisor Entwistle met with David. He is currently doing wildlife survey, and wetland delineation. He will submit the application to the State in the fourth quarter of this year. They will be discussing tax implications in the Fall as the town has opted out of the PILOT program (payment in lieu of taxes).
  • Area Variance-Steven Eckels-Woodgate Storage: The business and home are on one lot, and he would like to subdivide because he would like to dedicate on driveway to the business. He has 50’ of road frontage so he is looking for an area variance to subdivide.

A motion was made by Councilwoman Kardash and seconded by Councilwoman Abrial to schedule a Public Hearing May 18, 2022, at 6:15PM.

  • Electronic Deposit-Town Clerk: The Town Clerk would be able to deposit checks remotely and not have to go to the bank. Banking would be for cash only.

The meeting was called to order at 9:00 am by Supervisor Entwistle. Supervisor Entwistle read the legal notice aloud.

Notice is hereby given that the Town Board of the Town of Forestport will be holding a Special Meeting for Sewer District #1 at 9:00 am on March 24, 2022 at the Forestport Town Hall, 10275 Route 28, Forestport, NY 13338.

The special meeting is being held to formally pass a motion to schedule a public hearing regarding the increase and improvement of the Forestport Sewer District facilities pursuant to New York State Department of Conservation regulations.
The meeting is open to the public and voting will take place.

A motion was made by Councilwoman Kardash and seconded by Councilwoman Verschneider to schedule a Public Hearing April 20, 2022 at 6:15PM for an increase and improvement for the Sewer District.

  • Mr. Flickinger, from the gallery asked what the non-conforming lot means.
  • Supervisor Entwistle stated most houses along that stretch are within the blue line.
  • The house is already too close to the water according to the Canal Authority and this will make it a little closer. They want to take the deck off, add an addition and put the deck back on 8 or so feet. They are asking the setback for the addition be reduced from 100’ to 29’ from the mean high water and the 50’ to 36’ from the road boundary line.
  • Blue line water regulations were discussed.

  • Pat Howard, from the gallery asked what they plan on doing with the property. Mr. Allison stated they might sell it or rent it out. Karen and Pat Howard spoke in opposition to the subdivision as it is on 3/4’s of an acre with neighboring properties.

OLD BUSINESS:

  • Supervisor Entwistle stated the NYS DEC is mandating updates of the effluent discharge systems. This needs to be completed by 2024. If you are not in the sewer district, this does not apply to you. The only ones affected are the ones on the sewer district.
  • The Town has applied for two grants. These grants are usually offered alternate years, but because nothing was offered in 2020, the Town applied to both grant programs in 2021. The Town received $1.2 million dollars from the Water Quality Improvement Program and is waiting to hear back from Water Infrastructure Improvement Act. The awards have not been made yet, but it could cover up to 75% of the remaining costs. If the Town received both grants, there is a low interest loan offered through the State clean water revolving fund. They require a detailed application that was due March 1, 2022. Most components were submitted in November and December the one component was not submitted though the Engineer and bond counsel. The paperwork was going to be in place for the February meeting but didn’t receive it. If there wasn’t an emergency meeting, the town would’ve missed the first round of possible funding.

  • Allison Area Variance: The Allison Variance is tabled until next month. Mr. Allison gave the Town Board permission to walk the property.
  • Quarry Update: The Planning Board held a Public Hearing regarding the Town approval of the Quarry on Stone Quarry Road. It was attended by in-person and via zoom. The DEC and APA has approved Mr. Sunderlin’s permit to mine the area. The Planning Board is reviewing his application to the Town for Site Plan. The majority of what is being reviewed is the use of a seasonal town road to access the mine site. The Planning Board is currently waiting on a 239 Review from County Planning Office to review the project, DOT for the intersection of Route 28 and Stone Quarry Road and a couple other minor things. The next Planning Board meeting is April 13, 2022, at the Town Hall at 6:30PM. It will be on zoom as the Planning Board recessed the Public Hearing. The zoom link will be posted on the town website.
  • Highway Barn camera: Big Apple music has installed a camera aimed at the gas pumps at the Highway Barn.

NEW BUSINESS BOARD:

  • Yoga Room: The Town is working with Wholesome Living and other yoga instructors to create this Yoga space. Ash Fletcher has a Yoga program on Wednesday at 10am and Teresa Nickerson Yoga Fire is Tuesday at 5:30pm. Anyone interested in teaching Yoga or Zumba can utilize the space. In discussion regarding the Yoga room, Karen Howard asked if they could rent a room for the Cemetery. Supervisor Entwistle stated the rooms are currently full, but if there is an opening they could discuss it.
  • Camp Nazareth: They will be opening up this summer. They increased the cost to the Town to $300 per camper. There is approximately $6,000 in the budget to send the children. If the Board pays the total cost, they could send twenty campers. If parents pay a portion, they could send a few more. Councilwoman Kardash stated if it’s the first time, they should go for free and if it’s the second time, they should pay something. There were a lot of generous donations which is included in the $6,000. Registration is not open yet as the Town doesn’t have the applications. Once they do, it will be posted on the website. It’s open to children ages 8-15.
  • Summer Recreation: Supervisor Entwistle has reached out for instructors but hasn’t heard anything back yet.
  • Trail Counters for Trackside Blazers: The Town has contributed money towards these trail counters. There was one at the Alder Creek intersection and one by the Clubhouse on Horton Road. The Horton Road counter shows177 snowmobiles a day and the Alder Creek intersection shows 53 sleds a day. The town felt this is useful because when the town applies for grants, data is the basis for the grant award. There is an invoice from Trackside Blazers.
  • Alder Creek Solar: They are currently working on wildlife surveys and once the snow goes, they will be doing wetland delineation and cultural resource testing. They are submitting a jurisdictional determination package to the DEC and the Army Corp of Engineers to get the wetland limits reviewed and approved. There is a several month turnaround time. They are planning on submitting the application in the fourth quarter of this year. Once they submit it, they will be discussing the PILOT program.
  • StaR Ambulance Merger: Supervisor Entwistle attended a meeting with the Trenton, Remsen and Steuben Supervisors and Brian Healey with StaR ambulance and Tom Meyers, Central Oneida County Ambulance. StaR Ambulance is in a great place financially, but do not have staff due to COVID. StaR has entered discussions with Central Oneida County Ambulance to merge with them. StaR would maintain their name and service. Central Oneida County Ambulance would be responsible for billing and filling the gaps when STAR staff is low. StaR has had to eliminate overnight paid staff. StaR needs all Town’s approval for the merger to take place. The goal is to have the merger completed by September. With Central Oneida County Ambulance, there is a possibility of having Forestport residents obtain EMT training. There is also the possibility of offering Tele Health to individuals who would like to do that instead of riding in the ambulance. Central Oneida County Ambulance has the ability to compile data to see where the most calls come from, the time of call and the need. There may be a possibility of having an ambulance stationed in Forestport from time to time. Discussion took place regarding certificates of need.

  • Old Forge Ambulance: Gary, the President of the Old Forge Ambulance and Danielle attended the meeting and stated Old Forge Ambulance would like the contract to be changed. Supervisor Entwistle asked Gary to come up with the new language and the Board will review it. Gary also asked the Town Board to consider an increase in funding to be able to provide the ambulance service. Last year they had 57 calls to Forestport.
  • Ash Fletcher: Supervisor Entwistle read a letter aloud from Ash Fletcher with her building use requests. Ash has been charging the town $50 a week for the senior yoga. Temporarily while she’s using the gym for dance, she’s not charging the Town for the yoga and the town is not charging her for the gym use. All the yoga instructors pay rent, but in this particular situation, while Ash is doing the yoga for the town, she will not be charged. Once the Yoga space is completed, the Town Board will reevaluate the space rental.

A motion was made by Councilwoman Abrial and seconded by Councilman Scouten to allow Ash Fletcher to use the gym and Yoga room for the Spring retreat and Spring Training for Just Dance.

  • Building use: There is a lot of community use for the gym. When someone is done using the gym, they need to return the key. If they want to rent again, they have to submit another request.
  • Mileage: Supervisor Entwistle stated with gas prices increasing, he suggested raising the rate to 58 cents per mile. The Federal reimbursement rate for mileage is 58.5 cents per mile. Councilwoman Kardash suggested 56 cents per mile.

A motion was made by Councilwoman Kardash and seconded by Councilwoman Verschneider to raise the gas mileage rate to 56 cents per mile.

  • Website: The Town is currently using Digital Towpath. The Town Board discussed where the money would be taken out of for a new website company. Coughlin is very responsive when you call and are cheaper than the other companies, they are ADA compliant and there is an option for an email alert that’s posted to the website. The Town Clerk has been putting minutes on the website from 2008, but there is an issue is when they get scanned in. You can’t search those minutes because they are scanned in. For an added fee, there is a program that allows for scans to be readable.

A motion was made by Councilman Scouten and seconded by Councilwoman Abrial to approve changing the website company to Coughlin.

NEW BUSINESS PUBLIC:

  • A woman from the Gallery stated on Kincaid Road, they dug up a foot and a half on her yard. She asked if they were going to fix it. Supervisor Entwistle gave her Bill Gardner’s cell phone number.
  • Ron, from Trackside Blazers thanked the Board for their support. He said the cooperation from Bill and the highway guys was outstanding. Trackside Blazers donated $500 to a local food bank. He said maybe next year they can make a donation for Camp Nazareth.

Town Board Emergency Meeting Minutes – 03/01/2022

CALL TO ORDER:
The meeting was called to order at 9:30 am by Supervisor Entwistle.
Supervisor Entwistle read the legal notice aloud. This was posted to the Town website, social media and local radio station as of 8:00 am on March 1, 2022.

There is a contract agreement with Orrick for bond counsel work for the Town of Forestport’s portion of the wastewater treatment plant grant. The Environmental Facilities Corporation through the New York State Department of Conservation has awarded the town $1.4 million dollars for the project and the town is responsible for up to 25% which is $350,000.00. The Town is going to bond for their portion for the sewer district. Supervisor Entwistle read resolution #2 of 2022 aloud
