The meeting was called to order at 5:45 pm by Supervisor Entwistle

NOTICE IS HEREBY GIVEN that the Town Board of the Town of Forestport will be holding a Public Hearing on April 19, 2023, at 5:45 PM at the Forestport Town Hall, 10275 State Rt. 28, Forestport, NY. The Public Hearing is being held to review and accept public comments regarding the closure of Maple Road from Route 28 to the end of White Lake Inn property on June 3, 2023, from 10:00am-10:00pm for “Lightning at White Lake Block Party” and the closure of River Street on August 26, 2023, from 10am-6pm, for “Old Forestport Days”.

PUBLIC COMMMENTS:
No public comments were made.

Meeting was broadcast via Zoom, and attended in person by 12 members of the public

PUBLIC HEARING:

Change of Use – to sell firearms from his home location
o P. Anthony submitted a letter of support
o Members of the public voiced concerns over
 Safety concerns with having a gun dealer in their quiet residential neighborhood
 Would the residential area now be deemed commercial
 Increased traffic and parking issues
 Safety issues for their children/grandchildren
 Devaluation of their properties
 Monitoring of the business, types of firearms, and any arising issues
o A summary of the business plan to be reviewed by the Board was read, and each of the issues addressed.
 It was explained that the Board’s responsibility was solely to review a business request and ascertain that it meets all Town requirements. They cannot rule on civil matters, or determine personality or character.
 Any issues other than the Town’s responsibility for a business permit should be addressed to the ATF, who is issuing the license, or to civil authorities.

• The Board voted to Conditionally approve Mr. Frank’s request for a business permit based on pending receipt of his valid Federal Firearms license from the ATF, and the following

PUBLIC COMMMENTS:
Supervisor Entwistle stated the county has raised the limit to $37,900.00. It was at $28,000.00. He went over the guidelines and stated if there are any questions, Tonya can help them. Art Gleasman from the Gallery asked if it was just for town taxes, not school taxes. Supervisor Entwistle stated that was correct. Deb Brayton from the Gallery asked if it was gross or not. Councilwoman Kardash thinks it is the bottom line because it was changed. Anne Pelno, from the Gallery asked if a widow is not filing because they are only getting Social Security, can they still be eligible? Supervisor Entwistle said even if they do not file, he believes they do a postcard filing. The income would be under the minimum and could still qualify for the exemption. This law is currently in the books, but the Town is repealing that one and raising the limit.

Art Gleasman, from the Gallery asked if this applies to the school taxes, Supervisor Entwistle stated he did not know. Supervisor Entwistle stated you get a 10% reduction in your assessed value, so it would apply to Town/County Taxes and may apply to school taxes. Art Gleasman, from the Gallery stated the Firefighters get a $200.00 tax credit and you can’t take both.

OLD BUSINESS BOARD:
NEW BUSINESS BOARD:
• Water Year-End Report: This has been completed and should be available shortly and will be on the website.
• Water Operator – Lucas Kafka is the new Head Water and Sewer Operator and will be taking over for Ted Daktor. He is currently working for the Sewer Department in the Village of Boonville Full time.
• Buckhorn Water releases from property owners- They are currently in the process of receiving the releases. There are approximately twenty more that need to be returned.
• Sewer Project Update- Supervisor Entwistle and Jim were able to look at the plans. There will be a new generator, all 4 sewer beds will be changed. Two beds will be absorption beds and 2 pressure dosing beds for the wintertime. The pressure dosing beds push the effluent into the beds below ground level so the frozen ground on top doesn’t affect leaching. A couple new
wet wells. Construction is slated to start late Summer, early Fall of this coming year. Anne Pelno, from the Gallery asked what the drilling was for. Supervisor Entwistle stated they had to do core samples, so when they dig, they are not hitting bedrock quickly.
• Sewer- Replacement of Lift Station pumps- There are two lift stations one on Dutch Hill and another one behind the Sewer Plant. Each has a couple pumps that pump sewer from homes that are lower than the sewer plant to the sewer plant. Both pumps have been there quite a while and one pump in each station needs to be replaced. The good ones are pumping 70-80 gallons/minute and the bad ones are pumping 25 gallons/minute. Supervisor Entwistle has reached out to Gormann Rupp and they have given a basic estimate. Jim and Supervisor Entwistle will meet with the sales rep when the snow melts because the Town has some parts and pieces to pumps that have been rebuilt. Supervisor Entwistle has also reached out to the Environmental Facilities Corp., and they are doing another round of wastewater sewer funding. Applications for the grant are due Mid-June.
• James Allison Variance- Supervisor Entwistle spoke with Mr. Allison after the Public Hearing last month, stating he would be speaking with the Tughill Planning Commission and the Association of Towns. There was legal action taken against the Town last May after it was initially approved. The variance was overturned because a critical piece of paperwork was not done. The Tughill Planning Commission and the Association of Towns thought it was substantial and being overturned was reasonable.
A motion was made by Councilman Scouten and seconded by Councilwoman Kardash to deny the Allison Variance.

• Summer Recreation- Supervisor Entwistle and Councilwoman Verschneider have been discussing the possibility of a Summer Recreation on a limited basis and he has spoken with Ash Galligan. Ash has done some yoga and art classes at the Town Hall. She currently works at the Elementary school and is willing to run a program for the Town and will put a curriculum together, 3 days a week from 9am-12pm, ages 7-12. Councilwoman Kardash stated a head count should be done first to make sure there are enough children interested. Supervisor Entwistle wants to advertise with a deadline of the end of April. If there is a lot of interest there may need to be two assistants. Councilwoman Verschneider asked what about the grandkids. Supervisor Entwistle said they follow the Town website fairly good. Snacks were discussed. One of the waivers is there will be no riding the bike or walking to the program. Ash will be paid $20/hour and the Assistant $16-$18/hour.
• Camp Nazareth- In light of the Summer Recreation Program, the Town will be limiting the sponsorship to 16 children and asking the parents to contribute $50.00. Councilwoman Kardash stated the priority should be given to the residents’ kids and then the grandparents’ kids. Supervisor Entwistle suggested having applications open to resident kids for 3 weeks and then if there are slots leftover, open it up to seasonal residents.
• Local Law #1 of 2023: Property Tax Exemption for Volunteer Firefighters and Ambulance Workers- Carl, from the Gallery asked if there are minimum requirements to apply for it. Supervisor Entwistle went over the eligibility requirements.

• Planning Board of Appeals- A Public Hearing was scheduled at last month’s Town Board Meeting for April 19, 2023, at 6:15 P.M. This will be a 3-member board that will review and rule on variance applications denied by the Planning Board. It is a paid position. The proposed Local Law is as follows:

• Master Plan Update- The Master Plan Committee Meeting was cancelled Tuesday night, due to the weather and they are waiting for proposals from consultant firms. One proposal came in last month, one will be ready by the end of the month and the other one said their workload is too large to do it this year. Supervisor Entwistle stated he will be looking for another company. Once the proposals are together, they will schedule another meeting.
• Alder Creek Solar Project Update- Supervisor Entwistle received a letter from David Holly, the Representative of Alder Creek Solar, stating the timeline has shifted. They are waiting on an agreement, and they must enter a later class year of 2025 and operation date of 2027 or 2028. Things are currently on hold.
• Unpaid internship- Haakon Knudsen is currently in the process of applying to colleges and is looking for a meaningful internship. Currently there is a Sewer project grant, Bridge grant and Master Plan grant. Supervisor Entwistle is in the process of applying for another grant to change the sewer pumps. Once the grant money is received, complicated paperwork needs to be filled out. He is looking for Haakon to assist him and Jennifer in going through the emails, paperwork, and phone calls. Haakon would be set up in his own office, with a Town email address and keys. There is a small budget in the Master Plan Grant for clerical work, so he may receive some of that.
• Bids for concrete at the Town Hall- Councilwoman Verschneider asked if they were looking for bids to do the concrete work. Supervisor Entwistle stated they were and asked if she would like to solicit the bids and she answered she would. Anne Pelno, from the Gallery asked if they were putting concrete around the whole building. Supervisor Entwistle stated they would like to put a curb cut on the side of the building so you can drive up and park. The long-term plan, if they can get a grant is to eventually have a paved rear entrance for the court. Councilwoman Kardash stated they could have a something to lock up the court area because the building is used frequently. Supervisor Entwistle stated he would like to fix the lock on the side door.

Change of Use – to sell firearms from his home location. Mr. Frank stated that he will be selling firearms he will purchase out of state, and mainly to family and friends. He will also be doing some pistol-smithing. The County ATF has given their approval, and a copy of his license will be submitted for the file.
A public hearing was scheduled for April 12, 2023 – motion by Ultsch/Daktor

• There was further discussion regarding the formation of a 3-member Town Board of Appeals to handle Variance requests, as outlined in the NYS Town Laws. This will be put before the Town Board for review.

The meeting was called to order at 6:30 PM by Supervisor Entwistle. He started off by saying tomorrow morning, Terry Larkin will be honored with the Liberty Medal, the highest civilian honor in New York State at the Forestport Diner.
Supervisor Entwistle also noted the passing of Larry Ritter who was a longtime Town Board and Planning Board member. He was integral in the current Subdivision Law and an all around good guy.

Lisa Bellinger, of NOCCOG went over the monthly announcements.
OLD BUSINESS BOARD:
• Engineering Update-Sewer: Jack Dodson outlined the parameters; all four sewer gravity dosing beds will be replaced with two gravity dosing beds and two pressure dosing beds for the wintertime. There will be a new basket manhole generator and run a new line so they can take samples from inside the building. There will be two new manholes going in. The effluent will get passed through a row of chlorine tablets after it goes through the beds before it goes into the river. It is a low dose of chlorine. Once the plans are back, it will be put out to bid and construction should begin in the late Fall and finish before the Summer of 2024. Joan Ingersoll, from the gallery asked how many people were on the sewer line. Supervisor Entwistle answered 61 actual customers and 89 properties. The town qualified late last year for $400,000 and the grant writer is still trying to get more money. Joan asked if the Town has reached out to Griffo. Supervisor Entwistle said he has spoken with Griffo’s Assistant and reaches out every 2-4 weeks.
• Beechwood Cemetery: The Town Board approved a slate of officers at the Beechwood Cemetery Association Meeting at 6pm prior to the Town Board meeting. They are as follows:

Someone from the gallery asked who to contact if there is a death for a burial. Supervisor Entwistle said they can call anyone on the Board but will most likely get John Jones. Generally, the undertaker takes care of these things and will reach out to them directly.
• Master Plan Update: The Master Plan Committee met last week. They are currently in the beginning stages and are familiarizing themselves with the steps. There are three consultant companies that were recommended and once a company is hired, fliers will be mailed out to every resident, landowners and visitors. Hard copy surveys will be available at the Town Hall and local businesses, post offices and the Highway Barn. The company sees what the vision is and goals. The Town is ineligible for a lot of grants because they do not have an updated Comprehensive Plan. A lot of the Master Plan is tied to the Smart Growth principles.
• Planning Board Appointment: There was a vacancy on the Planning Board. The Planning Board reviewed the applicants and recommended Allison DeTraglia. She has an extensive background and is from the area. There was a total of 8 applicants. Some applicants were not eligible because they were not residents of Forestport.
A motion was made by Councilwoman Abrial and seconded by Councilman Scouten to appoint Allison DeTraglia on the vacant seat of the Planning Board.

• James Allison Variance:
This is being tabled until the March meeting. Supervisor Entwistle has reached out to other Association of Town’s Attorney’s to see what they have to say regarding the variance because he wants to make sure it is a viable variance.

NEW BUSINESS BOARD:
• Resolution #1 of 2023: DOT Local Road Inventory: Supervisor Entwistle stated they have a list of local roads with mileage and where it starts and ends. Stone Quarry Road has always been on the list, but for some reason has not been on the list the last couple years.
A motion was made by Councilwoman Verschneider and seconded by Councilwoman Abrial to pass Resolution #1 of 2023.

• Local Law #2 of 2023: Aged Exemption: Supervisor Entwistle went over the highlights of the proposed Law and stated if people have questions, they can reach out to Tonya Brown, the Assessor. She is in the office Monday and Tuesday 9am-2pm.

A motion was made by Councilwoman Kardash and seconded by Councilwoman Abrial to schedule a Public Hearing for Aged Exemption, March 15, 2023, at 6:00PM

• Local Law #3 of 2023: Supervisor Entwistle stated when he was on the Planning Board, they petitioned the Town Board to create a Zoning Board of Appeals. The Local Law would create a three-member Planning Board of Appeals regarding use and area variances, meeting when necessary. Supervisor Entwistle spoke to those in attendance that applied for the Planning Board position, to consider a spot on the Board of Appeals and to call him with any questions.
A motion was made by Councilwoman Kardash and seconded by Councilwoman Verschneider to schedule a Public Hearing on April 19, 2023, at 6:15 for Local Law #3 of 2023.

Meeting was called to order at 6:30 pm by Chairman Rejman, with four members present in addition to Town Supervisor Entwistle, Matt Johnson of the Tug Hill Commission, and various members of the community.

The Minutes of the January 11, 2023 were approved on motion by Terry/Daktor

New Business There was none.

Old Business
• The issue of proposed changes/updates to the Variance protocol was discussed.
o in the past Five years there have been only six (6) requests for road frontage variances.

o Matt Johnson of the Tug Hill Commission reiterated that Planning Boards’ procedure is to review and make recommendations for variances, and send it to a Board of Appeals for action.

He suggested:
 Amending the Site Plan Review Law by mapping different districts with different rules for frontage and lot sizes (only) according to the way the Town has developed. i.e. outlying districts versus cluster divisions.

 Creation of a separate 3-person Board of Appeals (this will be brought before the Town Board) Tug Hill Commission would offer training to such a Board.

o Because the Town’s Comprehensive Plan is being revamped, it was decided to table this issue at the Planning Board level for the time being: Ultsch/Daktor

General Discussion There was none

The Board adjourned to Executive Session at 7:15 to discuss a personnel matter.
Upon their return at 7:40, there being no more matters brought before the Board, the meeting was adjourned at 7:44 pm. Daktor/Ultsch

Meeting was called to order at 6:30 pm by Chairman Rejman, with three members present. (G. Ritter did not renew her appointment)

The Minutes of the December 14, 2022 were approved on motion by Ultsch/Terry

New Business
• James Allison: Parcel 19.001-1-22, 1174 Bear Creek Rd. (D Frymire) Submitted a revised Subdivision request, and updated plans showing a new driveway location (which has received a permit from DPW). County Planning will be contacted to confirm that their May 2022 approval of the 239 is still valid.

 The Variance request was categorically denied and sent to the Town
 Board for review.  (Terry/Ultsch)

• Supervisor Entwistle: Submitted and reviewed a list of potential changed to the SRL and Fee Schedule:
o Remove “Sanitary Privy” from the Fee Schedule
o Remove Demolition Permit $0.00 from the Fee Schedule
o List any “storage building/shed” over 300 sf as a garage or pole barn
o Remove fire inspections from the Fee Schedule
After a brief discussion, the Board acknowledged the validity of the
proposed updates.

Old Business
• Tim Hulser: Parcel 13.000-1-9, Rte 28 (D. Frymire) Update on Snowtrail Subdivision

Mr. Frymire reported that the Board of Health approval has been received. In addition, new maps were presented showing the location of the test well, and a revised driveway configuration: from four highway entries to only one, with a 50 ft. easement. In conjunction with Article VI, Section 12 of the Subdivision Law, the Board voted to approve these modifications to their original approval of the site plans. (Ultsch/Terry)

General Discussion
Pursuant to recent discussions regarding the number of variance requests coming before the Board for lot sizes, road frontage, and flag lots:

  • The Secretary will review the denials from the past five years due to lot dimensions.
  • Chairman Rejman tasked the Board members with preparing a list of
    o Items they would like to see changed,
    o Solid examples of such from other towns/districts
    o Their proposed changes, and
    o The rationale behind such proposals
    to be presented at the February meeting, which will also be attended by
    Matt Johnson of the Tug Hill Commission, who will share his insight.
