Supervisor Entwistle called the meeting to order at 6:30 pm with the Pledge of Allegiance.

TOWN OF FORESTPORT WORKPLACE VIOLENCE, CODE OF CONDUCT FOR PUBLIC MEETINGS, REMOTE PARTICIPATION AND SEXUAL HARASSMENT POLICIES:
A motion was made by Councilwoman Abrial and seconded by Councilman Scouten to approve the Code of Conduct for Public meetings, Remote Participation Policy, Workplace Violence, Sexual Harassment and Travel Policies as a whole.

• Supervisor Entwistle mentioned his office hours are going to be Mondays 8Am-12PM as they were not under General Rules.
EMPLOYEE BENEFITS/OFFICIAL HOLIDAYS
Supervisor Entwistle mentioned the Town Clerk brought it to his attention Juneteenth is on the third Wednesday of the month in June. The June meeting is moved to the 20th, a Thursday.
A motion was made by Councilwoman Abrial and seconded by Councilman Addison to approve the Employee Benefits/Holidays.

CALL TO ORDER
The meeting was called to order at 6:30PM by Supervisor Entwistle. The pledge was recited.

GUEST SPEAKER: Engineers from Barton & Loguidice reviewed the scope of the Round Lake Road bridge project.
95% of the grant for the project is coming from the State with a 5% match from the town. If the cost is over $1.2 million, the town would be responsible for that. They are currently in the Preliminary design phase. The project has a tentative start date of July 2025 and will take approximately three months to complete. Bob Whitehead, from the gallery stated he would like to have a dry hydrant put in because the town does not have a lot of dry hydrants. By doing this project, it would be an excellent time to do so. Supervisor Entwistle stated they would look into it. The public comment period will be open until the end of next week. Below is the handout from Barton & Loguidice.

OLD BUSINESS BOARD:
• Comprehensive Plan Update-The Comprehensive Planning Committee met with the Planning Consultant, and they had 100 samples of questions. They narrowed it down to 35 questions. The questionnaire will be put on the website Mid-late January. The Planning Consultant stated they usually have a 20% response rate. Supervisor Entwistle is hoping to surpass that percentage.

• End of Year Meeting- December 28, 2023, at 11AM
• Organizational Meeting- January 3, 2024, at 6:30PM
• Bookkeeper Position- Dawn Campbell will be retiring in May. They are interviewing for the Bookkeeper position and a Part Time Assistant Bookkeeper position. Sometime in January, they will sit with Dawn, to see what she does on a busy day. There are three qualified candidates. Dave Ultsch, from the gallery asked if the position was Full Time and if there is an Assistant right now. Supervisor Entwistle stated it is a Full-Time position and there isn’t an Assistant. If something were to happen to the Bookkeeper, there’s no one to replace her. The Assistant’s job would be to get the mail, water and sewer billing. The Bookkeeper position is going to move to a salary position instead of hourly.

Old Business
• Proposed Amendment to the Site Review Law regarding waste water treatment systems: The Supervisor submitted a draft of a proposed amendment for the Board’s scrutiny. D. Ultsch suggested some wording be changed, and a Waiver, such as is used in Old Forge/Herkimer County, be requested from the Dept. of Health. Supervisor will contact the Board of Health for clarification. The Board thanked the Supervisor for his input and assistance; they will review and submit their comments and final language before proposal is sent to the Town Board for a hearing.

Variance request for placement of new septic system

Information reviewed/verified with Mr. Cowen regarding placement of his new system. Mr. Beno, a neighbor, joined the meeting and stated his support/ approval of the project.

CALL TO ORDER:
The meeting was called to order at 6:15 pm by Supervisor Entwistle
LEGAL NOTICE:

NOTICE IS HEREBY GIVEN that the Town Board of the Town of Forestport will be holding a Public Hearing on October 18, 2023, at 6:15 PM at the Woodgate Fire Hall, 12445 State Rte.28, Woodgate, NY, 13494. The Public Hearing is being held to review and hear public comments regarding proposed Local Law #5 of 2023, Public Nuisance Abatement Law.
BY ORDER OF THE TOWN BOARD

PUBLIC COMMENTS:
• Susan, from the Gallery stated she hopes it passes as they have tried every avenue. She also handed letters signed by the homeowners on Bower Road that will placed in the minutes book.
• Supervisor Entwistle stated when violations become habitual and they have reached out to the police to no avail, the law allows them to make a complaint to the town deemed a Public Nuisance. The first step is a complaint to the Codes Officer, and he does an investigation. If he feels it is warranted, the next step is to have an Administrative Hearing, comprised of a 3-member board. One member is appointed by the Codes Officer and two are appointed by the Supervisor. The Committee can be anyone from the town. They would send a summons to appear before the committee to answer the charges. Both parties can present evidence. At the end, the committee can decide to proceed with two avenues. One is a temporary avenue- the certificate of Occupancy can be revoked for 30 days, issue fines up to $1,000 per incident and the second is to refer the matter to the Supreme Court. This avenue is a civil matter. The Town Attorney is paid on retainer no matter how much she works.
• Susan asks if the injunction could mean the ATVs are confiscated. Supervisor Entwistle stated he has to look into it.
• Supervisor Entwistle stated a lot of concerns are it is very specific and complicated. He wanted to make it clear, if it is passed could never be used in the instance of snowmobiles going on a legitimate snowmobile trail.
• Steve, from the Gallery asked if this able to be subpoenaed and do they have to show evidence to file a complaint. Supervisor Entwistle stated it is subpoenaed and if they make a complaint, they will fill out an initial complaint, deposition and any evidence to back their complaint. If there isn’t even information, the Codes Officer may deem this an unfounded complaint.
• Councilwoman Verschneider asked if they filed a complaint with the police. Supervisor Entwistle stated calling 911 is filing a complaint. The troopers have been unsuccessful in catching them in the act.
• Ron, from the Gallery asked if there were particular hours of the day this is in effect. It was answered no.
• Roy, from the Gallery asked about someone starting their diesel up every morning. Can this law get turned around, saying they were singled out. Supervisor Entwistle stated no, but possibly if it was used improperly, there are many steps before anyone will see results from this.
• Supervisor Entwistle stated this is not specific to snowmobiles or 4-wheelers.
• Dave, from the Gallery stated the law is too vague. He also asked about the Citizen’s Complaint.
• Dan, from the gallery asked if any of the Board members have been down Bower Road. Councilwoman Kardash stated she has but hasn’t been able to catch them.
• Anne, from the Gallery stated she had a similar issue and was given a phone number so the call wouldn’t go on the scanner.
• Supervisor Entwistle asked how many have received a copy of the Proposed Local Law. The Board is not going to vote on this and the Hearing will be recessed until next month. He asked that anyone with questions, comments or changes they would like in the Local Law to email them to the Town Clerk or himself. He also stated since Councilwoman Verschneider has been asking to have the State Trooper come to the meeting, he would like to invite the State Trooper and the Sherriff. He is going to see when they are available and try making a Special Meeting.
• Susan from the Gallery stated there is an actual situation happening now, but everyone is talking about a potential situation. Councilwoman Kardash stated as a Board member, when they pass a Local Law, they have to make sure it is right for the residents and for the future.
• Supervisor Entwistle stated this Law does not fall under a referendum.

The proposed Local Law #5 Public Nuisance Public Hearing was reopened at 6:30PM by Supervisor Entwistle and the Pledge was recited.

Supervisor Entwistle stated at this point it is clear where everyone stands for and against the Local Law. He will take a couple comments.

All letters submitted for the Public Hearing are attached to the minutes.

There were no public comments.

A motion was made by Councilwoman Kardash and seconded by Councilwoman Abrial to close the Public Hearing regarding the Nuisance Ordinance.

SEWER:
• WWIP: The town has applied for an extension for construction until Summer of 2025. There was a lag in the engineering portion. The engineer was missing the electrical diagrams, which the state can’t approve yet.
• Lift Station pumps: The lift station pumps on Dutch Hill are being repaired. They are due to be replaced as part of the WWIP.
OLD BUSINESS BOARD:
• Comprehensive Plan: The minutes will be on the website. The Committee meetings are open to the public. A community survey will be available online. The notice says contact the Planning Department, but people can contact Supervisor Entwistle or other members of the committee, including Steve Addison.
• Nuisance Law: This is being tabled until the December meeting. Should a board member not be at the December meeting, there will be a vote.


• Adoption of 2024 Budget:
A motion was made by Councilman Scouten and seconded by Councilwoman Kardash to adopt the 2024 Budget.

NEW BUSINESS BOARD:
• Purchase of AED for Town Hall: The Town is in the process of purchasing an AED for the Town Hall. Bob Whitehead, with STaR ambulance and his crew is prepared to train the employees at the Town Hall. Ron Davies, from the gallery asked if there was one at the Highway Barn. Supervisor Entwistle stated they will be getting one at the Highway Barn after they have one at the Town Hall.
• Senior Christmas Party: December 13th, at Awesome Country and it is a full house.
• Review of Planning Board of Appeals Salary:
• Bridge NY resolution: The Town received a grant of $1.1 million dollars to replace the Round Lake Road bridge over Little Long Lake outlet a couple years ago. In the past, they have contracted with the county and the State. This resolution allows the county to design and oversee the project, but the town is responsible for matching funds.
Supervisor Entwistle read the following resolution aloud:


The bridge will be closed for three months. A public notice will go out when the engineers come to the Town Board meeting to discuss it.
A motion was made by Councilwoman Kardash and seconded by Councilwoman Abrial to approve resolution #6 of 2023.

• NYMIR recommendations:
 Playground mulch: the mulch needs to be filled up to the level of the perimeter.
 Prior written notice law: this is regarding highway sidewalks and bridges. It’s for insurance purposes. Anyone who has an issue with a hazard and doesn’t report it, it protects the town with insurance claims.
 Town Hall curb: The curb is missing a couple of chunks. Jim and Matt will be taking care of it.
 Bleacher replacement: the bleachers at Dutch Hill are not code compliant because they do not have backs or sides on them. They are looking forward to getting them replaced.
• Review of Planning Board of review Salary: Supervisor Entwistle read a letter aloud from Planning Board of Appeals Chairman, Steve Addison. He requested the salary be increased to what the Planning Board members are paid, $128.75/ month and the Chairman getting an additional $42.90/ month.
A motion was made by Councilman Scouten and seconded by Councilwoman Abrial to increase the Planning Board of Appeals salary to the equivalent of the Planning Board and give the Planning Board of Appeals Chairman an additional $42.92 stipend per meeting .

NEW BUSINESS PUBLIC:
• Ron Davies, from the gallery stated there’s some trimming at Dutch Hill parking lot for the snowmobile trail. They moved the trail off the road. They mailed insurance certificates out yesterday. Supervisor Entwistle stated he has the email copy.
• Ron Davies asked what the signs were about. Supervisor Entwistle stated they have been welcome to Forestport signs from 15-20 years ago. Pete has been replacing all the signs and is finishing up the last of them this year. \
• Ron Davies asked about the $10,000 in a 2009 truck. Supervisor Entwistle stated it is the oldest truck they have so far. They have a 2015,2016,2018 and 2021. It was held off because of COVID. The new truck has been ordered, but they can’t get delivery until early 2025. When they get the new one, the 2009 will be put on Auctions International and they should be able to get $50,000. The new one is $200,000.

Variance request for placement of new septic system.

Public Hearing was called to order at 6:30 pm

Michael Porter, a neighbor/relative, attended the meeting and voiced his approval of the intended septic installation. There was no other response from the public

Public Hearing was adjourned at 6:45 pm (LeBuis/Fessler)

 

Regular Meeting opened at 6:45 pm:
Contractor Mike Hunkins had presented drawings and explained the waste water treatment system at the October meeting. Board members have since visited the property, and agreed that there was no alternative for placement of the new system, which will also protect the neighbors and the lake from contamination.

CALL TO ORDER:
The meeting was called to order at 6:30 pm by Supervisor Entwistle

LEGAL NOTICE:

 

PUBLIC COMMMENTS:
• Supervisor Entwistle read portions of the letter aloud from Laurie Fessler, for public comment and for the record.

• Supervisor Entwistle stated the Codes Department is running for less than when there was a Clerk. The Codes Department includes Tony, the Codes Clerk and Joe Rowlands, Code Enforcement Officer. Joe is doing the records and the inspections. He stated the NYS Codes Department reviewed some of the records and made suggestions. They are satisfied with the direction the Codes Department is heading. There are 107 permits issued for this year so far and that does not include septic permits. In the years 2018-2020, there were $6,000 in fines and fees. In the last three years, there has been $16,000 in fines and fees.
• Councilwoman Verschneider asked if the fees had a certain rate. Supervisor Entwistle answered they can change them. A few years ago, they increased the fee structure.
