OLD BUSINESS:
• Buckhorn: The Buckhorn Association had their meeting on June 4th and the
map study was presented. The $14,000 budget would be $318 a year per
customer and $79 a quarter. The $18,000 budget would be $102 a quarter
and $284 a year per customer.
➢ The Buckhorn district is unmetered water.
➢ Councilwoman Kardash asked if there was going to be enough money
in case something catastrophic happened with the water system.
Supervisor Entwistle answered they would have to bond through the
town.
➢ The Buckhorn Association has a Special Meeting July 9th, but they are
having issues with the majority of the homeowners available in
person. Supervisor Entwistle suggested having them use the meeting
room at the Town Hall and allowing people to zoom in. If they vote to
have the water district, the Town Bard will schedule a Public Hearing
at the July Regular meeting. If everything goes smoothly, the town
could potentially take over their water district next spring.

Supervisor Entwistle stated there was an issue with a dog and Craig brought the
dog to the Boonville Kennel instead of driving it to the Humane Society. Craig
suggested the Town of Forestport create an agreement with the Town of Boonville to use
the kennel for their dogs. Supervisor Entwistle stated they have to run it by the Attorney
and the Boonville Town Board has to discuss it.
A motion was made by Councilwoman Kardash and seconded by Councilwoman
Verschneider to approve the reports as a whole.

Camp Nazareth: There are 31 children signed up for camp this year. Supervisor
Entwistle thanked those who donated money pre-covid for children to attend
camp this year.
Summer Recreation: Notices were posted that the town was looking for
applicants for the Summer Recreation program. Only one application was
received. Next year, the Town Board will start putting feelers out in the Fall after
budget time.
Wildcat Program: This is on hold until next month.
Master Plan Update: June 1st was the first meeting and Supervisor Entwistle
stated it was productive. There is another meeting scheduled at the end of July.
There currently is not a contract for the grant money.
Website Launch: Supervisor Entwistle stated the website should be launching
soon and Tracy, the Town Clerk has done a nice job with the website. People will
be able to sign up for email updates.
Eckels Variance:
A motion was made by Councilman Scouten and seconded by
Councilwoman Verschneider to approve the Eckels Variance.

NEW BUSINESS BOARD:
NYMIR Renewal: The total is $34,523.00 and hasn’t changed much within the
last 5 years. Barb Curry, W.B. Payne representative and Dorothy, the Highway
Clerk do an excellent job.
Fireworks: The Town budgeted $2,200.00 for fireworks, but with the increase in
gas prices, this year the fireworks will cost $2,800.00. Councilwoman
Verschneider asked about getting donations for the fireworks. Supervisor
Entwistle stated the same businesses are always asked to donate. He suggested the
possibility of donation cans at local businesses for next year. He also mentioned
there is money from the stickers that were sold a couple years ago that can be
used towards the fireworks.
Planning/Zoning Grant: The Planning Board would like to do a major overhaul
of the Site Review Law to make it more up to date with climate smart
implemented. There is $100,000.00 available. Jen, the grant writer is an
independent grant writer.
Excellus Insurance: Supervisor Entwistle received the letter from Excellus and
they are asking for a 14.26% increase on health insurance.

A motion was made by Councilwoman Kardash and seconded by Councilman
Scouten to enter into Executive Session to discuss highway negotiations.

Planning Board Minutes – 02-09-2022

James/Minna Allison: 2-Lot Subdivision, Parcel 19.003-1-22, Bear Creek Road. No public comments. Meeting closed at 6:15 pm on motion by Ultsch/Daktor

J. VanValkenburg: 2-Lot Subdivision, Parcels 2.003-1-2.7 & 2.003-1-2.9,

Lakeview Road. Surrounding property owners attending the meeting had questions regarding placement of the division, and how it would affect their properties. After viewing the maps they had no issue with the proposed division. Meeting closed at 6:30 pm on motion by T. Terry/ G. Ritter

Old Business

  • James/Minna Allison: 2-Lot Subdivision, Parcel 19.003-1-22, Bear Creek Rd. The Board’s main concern was that the subdivision would not meet the requirements outlined in the Site Review Law. Although D. Frymire pointed out that White Lake Corners is designated for cluster development and the property meets the character of the area, the Board voted to deny the request, and sent it to the Town Board for a variance hearing. Motion by G. Ritter/T. Tyler
  • J. VanValkenburg: 2-Lot Subdivision, Parcels 2.003-1-2.7 & 2.003-1-2.9,

Lakeview Road. The subdivision request was approved on motion by A. Daktor/D. Ultsch

  • Deborah Eckels: 2-Lot Subdivision, Parcel 19.00-1-32.3, Rt 28. The matter was tabled until the March 9 meeting pending receipt of information from DOT and County Planning.

New Business

  • K. Lambert/W. Wheatley (A. Bailey / Codes): Setback variance on Parcel 85.001-2-50, 10436 Dustin Road. A letter of support for the Wheatley’s request was submitted by neighbor, Margaret Peterson. However, the request was denied (A. Daktor/D. Ultsch) as it does not conform to requirements of Site Review Law. Owners will apply to the Town Board for a variance.
  • Ruben Treminio (A. Bailey): 2 Lot Subdivision on Parcel 50.000-1-22.6, River Road. More time was needed to prepare and Mr. Bailey requested that the item be tabled until next month. Done, on motion by G. Ritter/T. Tyler
  • T. Sunderlin – Red Rock Assoc., regarding White Lake Quarry. DEC/APA have approved the Quarry application, and the final step is to meet all Town requirements for operating a business within the Town. Therefore, it was noted that the Board is not entertaining comment regarding DEC’s commercial permit, but will ascertain that the company meets the requirements and guidelines for operating a business in the Town. It was noted that many of these requirements have already been laid out in the DEC Permit. and a list of the Town’s business requirements was provided to Mr. Sunderlin. Key points included
  • Signage
  • Maintenance of the road (the Town attorney will draft an agreement
  • regarding upkeep, improvements, damage, etc.) Mr. Sunderlin
  • maintained that this will be at his expense
  • DOT permits must be in place
  • Consideration of a problem with traffic heading north; no right-hand
  • turns will be allowed
  • Requests have been made to reduce the speed limit in the area to 40
  • mph
  • Work to be done on the intersection to improve line of sight

An adjoining landowner, Mr. J. Turczyn, raised an issue regarding ownership of the roadway to the quarry. The Town lawyer will be consulted, and the matter investigated.

A public hearing was scheduled for March 9, 2022 (open, and via Zoom); time to be announced.

Supervisor Entwistle read through the appointments. Councilwoman Verschneider is the liaison for Senior recreation with help from Councilwoman Kardash and Supervisor Entwistle. Tonya Brown, webmaster stated she would like to resign from the position of webmaster. She suggested Tracy Terry, the Town Clerk be the webmaster as she is the keeper of the records and puts minutes and meetings on the website already. Supervisor Entwistle thanked Tonya for being the webmaster the last few years and told Tracy Terry, the Town Clerk to think about being the webmaster.

TOWN OF FORESTPORT WORKPLACE VIOLENCE POLICY FOR HIGHWAY AND TOWN HALL:
Supervisor Entwistle stated the Department of Labor required a risk assessment for the Town Hall and the Highway Department and an emergency action plan.

CODE OF ETHICS:
Supervisor Entwistle stated the Code of Ethics has been amended several times and should be looked at again sometime.

GENERAL RULES:
Supervisor Entwistle read the hours of operation for the Town offices. The Planning Board Secretary hours are changing. The Tax Collector’s hours are January: Monday, Wednesday and Friday 9am-1pm, February 14th, and 28th 9am- 1pm and March 16th and 30th 9am-1pm. Tonya Brown, the Assessor stated she would like to change her public hours to Tuesday’s only but will still be available to the public. Since August, she has had one person come in on a Monday. Supervisor Entwistle stated the Board will discuss it at the January meeting and let her know.

A motion was made by Councilwoman Kardash and seconded by Councilwoman Abrial to table Tonya Brown, the Assessor’s hours and to approve the remainder of the 2022 General Rules as presented.

TOWN BOARD AND PLANNING BOARD MEETING DATES 2022:
The Town Board meetings are the third Wednesday of every month, with January through April at the Town Hall, May, June and July in Otter Lake and August, September and October in Woodgate. The Planning Board meetings are all held at the Town Hall the second Wednesday of the month.

A motion was made by Councilwoman Verschneider and seconded by Councilwoman Abrial to approve the 2022 Town Board and Planning Board meeting dates as presented.

OLD BUSINESS BOARD
Grants the Town was awarded:

  • 1 million for the Sewer upgrade
  • 1.15 million was received by the Bridge NY foundation to redo the Round Lake Road Bridge.
  • The Town has applied for a small grant with Apex Solar for a permanent yoga studio for the community. There are currently 3 yoga teachers utilizing the building.
  • $30,600 was received to amend the Master Community Plan. The money is earmarked for the Town Board, Planning Board, APA, DEC, TugHill Planning Commission, community members and the County Planning to see where they vision the Town will be in twenty years. Examples: industrial, air bnb, or commercialized. The Master Plan is a tool the Planning Board and Town Board can use to consider the characteristics and moral of the community when new businesses are brought before them.

Trail Counters for Trackside Blazers: The cost is $2,300 for three counters. Supervisor Entwistle stated the counters are beneficial to the town because they give valuable data that can be used when they apply for grants. Trackside Blazers will purchase the counters and the town will reimburse them.

A motion was made by Councilwoman Verschneider and seconded by Councilman Scouten to approve the purchase of the counters.

Senior Recreation: The Town hosted a senior ski day January 5th. Another Senior ski day is scheduled for this Sunday. A meeting is scheduled for February 2, 2022, at 1pm at the Forestport Town Hall for Seniors and the Town Board to go over expectations for the program.

Ski program: Supervisor Entwistle stated the beginner ski day at McCauley was an enjoyable time even though the weather was not too good. There are 25 people signed up for the Gore trip.

Reappointment:
A motion was made by Councilwoman Kardash and seconded by Councilwoman Abrial to reappoint Dave Ultsch to the Planning Board.

Passing Zone: Starting in the Spring of 2022, the northbound passing zone near the Dog Obedience on Rte. 28 will be closed due to complaints.

Quarry: Supervisor Entwistle stated last Friday, the Adirondack Park Agency approved Mr. Sunderlin’s White Lake Quarry application. The DEC is following with their permit. The permit with conditions can be found on the APA and the DEC websites. The Town of Forestport does not regulate mining and the town Board and Planning Board have no jurisdiction over the mining operations that will take place. The APA and the DEC will be monitoring the site and do random check ins. The Planning Board is responsible for approving a new business for a change in use. The town hears concerns but can do nothing in regard to the mining. The only thing the Town has jurisdiction over is signage, parking, the road because it is a town road and they have limited input on truck usage and hours of operation. The town will be discussing the intersection of Route 28 and Quarry Road with the DOT. The next step would be Mr. Sunderlin going to the Planning Board to schedule a Public Hearing. The Planning Board will let him know what they are looking for. The Town road is 0.3 miles.

  • Mr. Rowlands attended a webinar for ARPA funds. If the Towns ARPA funds are under ten million dollars, the funds can be used for almost anything. The Final report can be found on home.treasury.com.
  • The NOCCOG Inter-municipal agreement amendment needs to be renewed.
  • Local Government Conference is still scheduled for April 19th.
  • Cannabis Management: Seminar was conducted February 9th.
  • Remote Meetings have been extended.
  • Local Roads webinars are almost over.

OLD BUSINESS BOARD

Highway Uniforms: Supervisor Entwistle signed a contract with Aramark in 2019 for the highway uniforms, thinking it was a three- year contract. It is actually a 60-month contract. In order to get out of the Aramark contract, it would cost $4,900.00. Supervisor Entwistle stated all the highway employees have their own t-shirts and pants and a contract not taking part in the Aramark contract anymore. Bill Gardner, Highway Superintendent will continue to maintain his uniform and allow Aramark to pick his uniform up and drop them off. It lowers the uniform bill and allows the Town to not breach the contract.

Quarry: The APA and the DEC have approved the Red Rock Quarry Associates application for a dimensional quarry at Stone quarry Road in White Lake. The applicant is currently in front of the Town Planning Board and a Public Hearing is set for March 9, 2022 at 6:15 PM. The Planning Board is currently looking at signage, and DOT traffic safety, road improvements. The Public Hearing will be available by Zoom and the link will be posted on the website.

Local Government Conference: Sign-ups need to be given to Tracy or Sandy.

NEW BUSINESS BOARD:

  • Kim Lambert-Variance Request: Dustin/McKoon Road appeared at the Planning Board meeting for an area variance for an addition. They are within the 100 feet setback from the water. Sandy has the maps in her office for viewing.

A motion was made by Councilwoman Kardash and seconded by Councilwoman Abrial to schedule a Variance Hearing for March 16, 2022 at 6:15PM.

  • Website: Tracy has taken over the website this year. She rearranged and added some pictures. She has researched other companies that handle municipal websites. Digital Towpath is $800/year and the Town has to pay the host for the website. The website is currently not ADA compliant. There has to be a method for the visually/audially impaired to use the website. Tracy will continue to do a little more homework and next month, the town Board will make a decision.
  • Sharon Cihocki: Supervisor Entwistle was approached by Sharon Cihocki that the Town/Village of Boonville will not be holding a summer recreation this year. They are trying to look at different townships that encompass the school district for a summer recreation program in the school district. That would come from the stimulus money. Councilwoman Kardash asked what town this would be held in, and Supervisor Entwistle stated Boonville. He thinks this program is aimed at kids that are going to summer school already for academic reasons. Councilwoman Kardash asked if they would be bussing the children from Forestport or if they would have to have a ride. Supervisor Entwistle thinks they would have to drive them as they drive them to summer school. Councilwoman Abrial stated summer school now isn’t like it was as anyone can go to summer school. Councilwoman Kardash stated the school was supposed to give Forestport an extra bus and they didn’t. The kids have to get on the bus at 6:20-6:30am.
  • Summer Recreation: Supervisor Entwistle stated summer recreation will probably start being discussed at next month’s meeting. Councilwoman Kardash asked if Camp Nazareth was going to be part of the summer recreation this year. Supervisor Entwistle stated he is planning on Camp Nazareth as long as they are able to function. The town is still holding onto money from those who donated money for children to attend camp Nazareth last year. Supervisor Entwistle wants the Board to think about where they would like the Stem Program to be held this year the Town Hall or the Woodgate School building.
  • Jen Piper: The Town has received the initial contract for the Master Plan Grant. The State is finalizing the budget and how that is broken up to the Town. Supervisor Entwistle has reached out to a Municipal Planner that he knows in Ithaca, and she has offered to help with her services for free. They discussed the initial survey out to the community. Do they want it online and send the community a post card? The survey questions and answers drive the project. A small committee of five people representing all walks of life and incorporating a ton of input through open houses and meetings. The goal is to have a committee and kick off plan but Memorial weekend. There is one volunteer that will be a good candidate.
  • Yoga: Councilwoman Kardash asked if Ash Fletcher could submit a list of seniors that are attending the yoga classes. Supervisor Entwistle stated he would let her know. Ash Fletcher has asked to use the library for dance classes Monday’s and Wednesday’s. Supervisor Entwistle said he’ll talk to her about the sign-up sheet and building use. Councilwoman Verschneider asked if she was going to be charged. Supervisor Entwistle stated he would find out what kind of participation she will be having. If someone is making money off the use of the building, they charge a fee. If there is a community activity, they do not charge a fee.
