The meeting was called to order at 6:35 PM by Supervisor Entwistle.
BUDGET AMENDMENTS:

A motion was made by Councilman Scouten and seconded by Councilwoman Verschneider to approve the General budget amendments.

Lisa Bellinger, of NOCCOG went over the announcements. She thanked the Town for supporting NOCCOG.
OLD BUSINESS BOARD:
• Compoli Variance: There were no public comments. Supervisor Entwistle said the Board did a couple site visits and spoke with the Code Enforcement Officer. Supervisor went over the 5 Factors for a variance.

A motion was made by Councilman Scouten and seconded by Councilwoman Kardash to approve the Variance.

• Highway Contract: Supervisor Entwistle negotiated a three-year deal with Teamsters. The Highway Employees are getting a reasonable raise every year, the health insurance has been restructured to benefit the Town and the employees. Juneteenth has been added as a federal holiday and the boot allowance has been increased to $160.00 from $150.00. Supervisor Entwistle is working with Lifetime Benefit Solutions, a third party out of Syracuse to handle the co pays. They will get a debit card when they go to the doctors and the co-pays go out of that.
A motion was made by Councilwoman Kardash and seconded by Councilwoman Verschneider to ratify the Highway Contract.

NEW BUSINESS BOARD:
• Year End: This will be held December 29, 2022, at 10 A.M.
• Organizational Meeting: This will be held January 3, 2023, at 6:00P.M.

• Wesley Kreager: Supervisor Entwistle stated He is looking to build a new home on O’Brien Road and has letters from surrounding landowners. The home that is there will be tore down and a new one built in its place, with new septic. There’s an entry way that is 8’ from property line and a deck on the other side that is 6’-7’ from the property line. He left letters from his neighbors. Supervisor Entwistle let Mr. Kreager know he needs two checks, a $50 variance Fee and $100 for the Variance Escrow.
A motion was made by Councilman Scouten and seconded by Councilwoman Abrial to schedule a Public Hearing on January 18, 2023, at 6:15 for the Variance.

NEW BUSINESS PUBLIC:
• Mr. Scholl, from the gallery asked the Board what they are going to do about Glenwood Place. Supervisor Entwistle has spoken with Bill Gardner; the highway Superintendent and he said it has been getting plowed this way. It is a difficult setup on that road. Supervisor Entwistle stated he is going to have Bill send a sander there after they plow and have them push the snow and use the one ton truck. Mr. Scholl stated the mailman cannot make the turn, so he has to back up and the Post Office said they cannot back up. Councilwoman Verschneider stated the mail is not a Town problem. Mr. Scholl voiced concerns about the banks.

A motion was made by Councilwoman Kardash and seconded by Councilwoman Abrial to enter into executive session regarding a Personnel matter.

• Further to the Board’s discussions regarding a review of the Town’s Road Frontage requirements, M. Johnson of the Tug Hill Commission has offered to meet with the Board on the subject.

Ambulance: .31 cents/1,000. Last year was .27 cents/1,000
Taxes are $2.26/1,000, which is under the tax cap. Supervisor Entwistle thanked the Board, Bookkeeper, Dawn Campbell, Town Clerk, Tracy Terry, Clerk for all their help.
A motion was made by Councilwoman Kardash and seconded by Councilwoman Abrial to adopt the 2023 Budget.

• Mrs. Fessler: Supervisor Entwistle stated the Board had the opportunity to discuss it with the Town Attorney, the Association of Towns and other towns. They do not have a responsibility to property owners, so public funds can’t be used to reimburse her. The suggestion was to go through small claims court to get the money from the contractor. Discussion took place.

• David Corrigan Variance:
A motion was made by Councilman Scouten and seconded by Councilwoman Abrial to approve the variance for Mr. Corrigan.

• Senior Trip/Lunch: Councilwoman Verschneider has a senior trip lined up to the Lyons Falls Christmas at Florissante on December 3rd with a luncheon at Awesome Country. There is a movie at the Town Hall in the gym at 1pm to watch Elf. He thanked Councilwoman Verschneider for the work she has done with the Senior program.

• Variance Request-Compoli:
A motion was made by Councilman Scouten and seconded by Councilwoman Verschneider to schedule a Variance Hearing regarding a side lot setback for a shed for Mr. and Mrs. Compoli on December 21, 2022, at 6:15.

• Jeannie Wolcott discussed the Open House at the old Art Gallery. She also stated Ashley Galligan is going to be an asset for Forestport, she is doing the art and yoga with the children in the Town of Forestport. She mentioned the Light up Christmas Parade in Forestport December 11th. The Wigwam does the toy drive on December 3rd. Susan O’Meara is starting a book club at the Woodgate Library. and it begins January 10th.
• Supervisor Entwistle stated the Community Hall in Woodgate may have some activities planned this winter.
• Supervisor Entwistle stated there is a growing interest regarding a St. Patrick’s parade in Forestport.

• Buckhorn Updates: Supervisor Entwistle stated a welcome letter has been sent to customers. The initial quarter bills have been sent out. They are currently waiting for the Attorney’s office to send out certified letters. Once they are returned, they can transfer the assets to the Town.
• John Broadbent, from the gallery asked if the guys for the water District are going to work for the Buckhorn water district. Supervisor Entwistle stated the billing collector and rent collector, operators are paid a separate stipend. The Buckhorn Water District is entirely separate than Water District #1. The Water money’s will not mix.

Public Hearing: Sewer District #1- November 16, 2022

CALL TO ORDER:
The meeting was called to order at 6:16 pm by Supervisor Entwistle
LEGAL NOTICE:
Notice is hereby given that the Town Board of the Town of Forestport will be holding a Public Hearing for Sewer District #1 at 6:15 P.M. on November 16, 2022, at the Forestport Town Hall, 10275 Route 28, Forestport, NY 13338.
The Public Hearing is being held regarding the increase and improvement of the Forestport Sewer District facilities pursuant to New York State Department of Conservation regulations.

PUBLIC COMMMENTS:
• Supervisor Entwistle started the meeting off by stating three years ago, the Town received a notice the DEC is regulating all municipalities to chlorinate their sewage affluent before it’s discharged into a body of water. This will take place this coming year. The Town received a $20,000 grant in 2019 to do the engineering study and $1.1 million toward the construction in 2021. At that time, the estimated cost was $1.4-$1.5 million- of which the Town would be responsible for $350,000. When the Public Hearing was held, the estimated rate increase was $12-$15 a month. The Town received a notice from the Engineer since the construction cost estimate was done a year and a half ago, construction costs have increased to $1.7-$1.8 million costing the Town $700,000-$750,000. Jen, the Grant writer has been able to get the cost down to $550,000. The purpose of the Hearing is to give an update and be transparent. The project is mandated by the State. We need to borrow $150,000 for 2023 for a portion of the construction, which will be borrowed from the General Fund so that there’s no interest. For 2023, the sewer rent increase is going to be $20/month. At the $20 increase it will take approximately four years to pay it back.
• Jeannie Wolcott, from the gallery asked if the $20 a month is only for the $150,000 but not the whole cost of the project. Supervisor Entwistle answered he wasn’t sure how this was going to play out in terms of construction costs over the next few years. The Board hopes in 2023, they can get another grant because it is a financial hardship to the sewer customers. At the end of 2023, they hope to reduce the bill by $2-$3.
• John Broadbent, from the gallery stated it’s an additional $80/month for him because of his four properties. He asked how long they are going to have to pay the $20/month. Discussion took place regarding the debt from 2002-2003. The current water and sewer debt will be paid off in 2033.
• The Consolidated funding application comes out in January 2023, and the Town is optimistic that we can get more grant funding to help offset the cost, due to the fact it’s a financial hardship on the sewer district customers.
• Mary Beth Reising asked about reaching out to politicians. Supervisor Entwistle stated he has reached out to Senator Griffo and NYS Assemblyman, Blankenbush and they are looking into it. The contact information for them is located on the Town of Forestport website.
• The increase will take effect in January 2023.

MONTHLY MEETING:
• Meeting called to order with Four members present; G Ritter was absent
• October 12, 2022 Minutes were approved on motion from Ultsch/Terry

New Business
• Compoli, Parcel 13.004-2-36, 1436 Bear Creek Rd.: Variance Request
Fine for lack of permit has been paid to Codes. Structure is 7 ft. from boundary line though neighbor has sent letter stating no problem. Discussion ensued whether to recommend removal, re-siting, or allowing variance. Variance request was categorically denied and sent to the Town Board for their review. On motion by Terry/Ultsch

• Bob/Mary Reith, Parcel 8.000-1-4 and -2.1, NY 28: Parcel Line Adjustment
Approved on motion by Daktor/Ultsch

• C. Luther (A. Bailey) Parcel 86.000-3-1: Maps of the proposed 3-Lot subdivision on O’Brien Rd. were reviewed. In addition, questions regarding possible usage of the remaining property (Lot 4, which abuts Happy Lake Campground), clarification of ingress/egress were discussed and responded to.
A Public Hearing was scheduled for 6:30 pm on December 14, 2022 to address the proposed subdivisions.

• Evans/Henry (G. DeTraglia): Parcel 52.000-1-11 / -1-18.2 Lot Line Adjustment.
The proposed lot line adjustment was reviewed, and approved on motion by Daktor/Ultsch, with P. Rejman recusing himself. Current maps will have a spelling correction made and be returned to be stamped by Planning for submittal to County.

NOTICE IS HEREBY GIVEN that the Town Board of the Town of Forestport will be holding a Public Hearing on November 3, 2022, at 6:30 PM at the Forestport Town Hall,10275 Rt. 28., Forestport, NY. The Public Hearing is being held to review and accept public comments regarding the 2023 Preliminary Town Budget. PUBLIC COMMMENTS:

Supervisor Entwistle stated the Town will be staying under the tax cap. He went over updates to the budget:

  • Buckhorn Water District was added to the budget. The first bill is due by the first of the year.
  • $800 was moved to independent auditing.
  • $1,000 was transferred to Records management Contractual.
  • Building and grounds contractual has increased to $100,000 due to rising fuel costs.

CALL TO ORDER:
The meeting was called to order at 6:39 PM by Supervisor Entwistle.

GENERAL:
A motion was made by Councilwoman Kardash and seconded by Councilwoman Verschneider to pay Abstract #10, Vouchers #522- #573 in the amount of $28,079.58.

OLD BUSINESS BOARD:
• Mark Fuller Variance: Supervisor Entwistle read the 5 factors for a Variance aloud.

A motion was made by Councilman Scouten and seconded by Councilwoman Verschneider to approve Mark Fuller’s Variance.

• Budget: The Town will be staying under the tax cap. Supervisor Entwistle would like to discuss the contracts with both ambulances together next year. He stated the reason they were able to stay under the tax cap this year is because the Town Board has done an excellent job spending less money than they make.
A motion was made by Councilwoman Kardash and seconded by Councilwoman Verschneider to accept the Preliminary Budget.

A motion was made by Councilwoman Verschneider and seconded by Councilwoman Kardash to schedule a Public Hearing for the 2023 Preliminary Budget on November 3, 2022 at 6:30 PM.

Supervisor Entwistle said the Preliminary Budget will be available in the Town Clerk’s office for inspection from now until November 3rd.
NEW BUSINESS BOARD:
• Tax Cap Compliance: Supervisor Entwistle submitted paperwork for the tax cap compliance. By submitting this paperwork, it guarantees a rebate check in 2023. It’s a courtesy of the Town Board.
• General Health Insurance: The insurance is going up 14%. The Board decided to leave it at $650 for 2023.
• Laurie Fessler: She stated she purchased her property 5 years ago. She wanted to email the Board, but they do not have public email addresses. She is looking for reimbursement because she stated the Code Enforcement Officer neglected to do his job. She discussed other issues she had with the Code Enforcement Officer. Supervisor Entwistle asked her to let the Board review the packets she gave to the Town Board and the Town Clerk, and the Board will respond to her.
• David Corrigan: Mr. Garlock has a proposed variance for a garage. It is 5 feet from the property line. They are removing the pavilion and adding the garage. Supervisor Entwistle asked him to bring in two separate checks. A $50.00 variance fee and a $100 Escrow fee.
A motion was made by Councilman Scouten and seconded by Councilwoman Verschneider to schedule a Public Hearing for an Area Variance for David Corrigan on November 16, 2022, at 6:00 PM

EXECUTIVE SESSION:
A motion was made by Councilwoman Kardash and seconded by Councilman Scouten to enter into Executive Session to review the Teamsters contract.

The Board returned from Executive Session at 7:24PM with action taken.
A motion was made by Councilwoman Verschneider and seconded by Councilman Scouten to approve the Tentative Highway contract through 2025.

NEW BUSINESS PUBLIC:

• Bob Whitehead, from the Gallery asked the Board to look into self-insurance after the first of the year. Tony Sege came to Supervisor Entwistle regarding this, and he hasn’t been able to get a hold of someone for this. Supervisor Entwistle stated he’s going to investigate the system and see what else can be done.
